What Is the ACT Certificate of Compliance ?

In the ACT, a Certificate of Compliance is the official document that confirms your pool or spa barrier meets current safety standards under ACT law.

It’s not just a formality — it’s required to sell, lease, or legally use any residential property with a pool or spa.

As of 1 May 2024, this is a legal requirement. If you don’t have one, your real estate transaction or tenancy could be delayed or invalidated.

🕵️ Who Issues It — And When?

Only an ACT-licensed pool barrier inspector can issue this certificate.

You'll receive it:

  • After passing a compliance inspection

  • When all pool safety standards are met

  • Typically valid for 3 years — but some conditions may shorten this

📦 When Do You Need a New Certificate?

You’ll need a new one:

  • Before putting a property on the market

  • Before leasing to a new tenant

  • If your previous certificate is more than 3 years old

  • If your fencing has changed, been damaged, or modified

❌ Common Reasons People Get Caught Out

  • “I thought it lasted forever.” Most certificates expire in 3 years.

  • “Nothing changed at my place.” Laws and fence standards may have.

  • “The previous owner had one.” Certificates are not transferable.
